New Article: Apple Defeats Samsung In SmartPhone Patent Infringement Case

SAN JOSE, Calif. — After a year of scorched-earth litigation, a jury decided Friday that Samsung ripped off the innovative technology used by Apple to create its revolutionary iPhone and iPad.

The jury ordered Samsung to pay Apple $1.05 billion. An appeal is expected.

Apple Inc. filed its patent infringement lawsuit in April 2011 and engaged legions of the country's highest-paid patent lawyers to demand $2.5 billion from its top smartphone competitor. Samsung Electronics Co. fired back with its own lawsuit seeking $399 million.

During closing arguments, Apple attorney Harold McElhinny claimed Samsung was having a "crisis of design" after the 2007 launch of the iPhone, and executives with the South Korean company were determined to illegally cash in on the success of the revolutionary device.

Samsung's lawyers countered that it was simply and legally giving consumers what they want: Smart phones with big screens. They said Samsung didn't violate any of Apple's patents and further alleged innovations claimed by Apple were actually created by other companies.

Samsung has emerged as one of Apple's biggest rivals and has overtaken Apple as the leading smartphone maker.

Samsung's Galaxy line of phones run on Android, a mobile operating system that Google Inc. has given out for free to Samsung and other phone makers. Samsung conceded that Apple makes great products but said it doesn't have a monopoly on the design of rectangle phones with rounded corners that it claimed it created.

The trial came after each side filed a blizzard of legal motions and refused advisories by U.S. District Judge Lucy Koh to settle the dispute out of court.

Deliberations by the jury of seven men and two women began Wednesday.

Samsung has sold 22.7 million smartphones and tablets that Apple claimed uses its technology. McElhinny said those devices accounted for $8.16 billion in sales since June 2010.

Apple and Samsung combined account for more than half of global smartphone sales.

As part of its lawsuit, Apple also demanded that Samsung pull its most popular cellphones and computer tablets from the U.S. market.

From the beginning, legal experts and Wall Street analysts viewed Samsung as the underdog in the case. Apple's headquarters is a mere 10 miles from the courthouse, and jurors were picked from the heart of Silicon Valley where Apple's late founder Steve Jobs is a revered technological pioneer.

While the legal and technological issues were complex, patent expert Alexander I. Poltorak previously said the case would likely boil down to whether jurors believe Samsung's products look and feel almost identical to Apple's iPhone and iPad.

To overcome that challenge at trial, Samsung's lawyers argued that many of Apple's claims of innovation were either obvious concepts or ideas stolen from Sony Corp. and others. Experts called that line of argument a high-risk strategy because of Apple's reputation as an innovator.

Apple's lawyers argued there is almost no difference between Samsung products and those of Apple, and presented internal Samsung documents they said showed it copied Apple designs. Samsung lawyers insisted that several other companies and inventors had previously developed much of the Apple technology at issue.

The U.S. trial is just the latest skirmish between the two tech giants over product designs. Previous legal battles were fought in Australia, the United Kingdom and Germany.

The U.S. case is one of some 50 lawsuits among myriad telecommunications companies jockeying for position in the burgeoning $219 billion market for smartphones and computer tablets.

A jury has ruled for Apple in its huge smartphone patent infringement case involving Samsung and ordered Samsung to pay $1.5 billion.

The verdict was reached Friday.

In its lawsuit filed last year, Apple Inc. had demanded $2.5 billion while accusing Samsung of ripping off the design technology of iPhones and iPads.

During closing arguments at the trial, Samsung attorney Charles Verhoeven called that demand ridiculous and asked the jury to award Samsung $399 million after claiming Apple used Samsung Electronics Co. technology without proper compensation.

The two companies lead the $219 billion market for smartphones and computer tablets. They are enmeshed in similar lawsuits in the United Kingdom, Germany and Australia. (SOURCE)

New Article: Nike To Cancel Midnight Shoe Releases

Wednesday, August 22, 2012

Looking to get your hands on a pair of $315 LeBron X sneakers? Don’t count on taking part in that sacred midnight release ritual.

Nike, the maker of the Lebron X sneakers, which are slated to debut this fall, told retailers they couldn’t schedule midnight releases for the shoes and instead would have to wait until 8 a.m. to start selling, according to the Wall Street Journal. In addition, Nike's rules require the stores to wait to post photos and descriptions of the shoes until after they launch.

The move may be an aim to prevent lines of customers camped out for days and the sometimes-violent riots that have become expected with the release of a highly-anticipated shoe. An Orlando, Florida, Foot Locker store called riot police earlier this year after crowds waiting for the midnight release of the Lebron Galaxy 9 and Foamposite Galaxy sneakers caused an intense stampede. The release was ultimately cancelled.

Azriel Gilmore, a manager at Burn Rubber, a sneaker store in Royal Oak, Mich., said Nike's new rules are likely an effort to prevent hordes of customers from gathering outside stores in anticipation of the midnight release.

What they're trying to do is stop the whole mobbish, 10-day camp-out for some shoe,” he said.

Although coveted sneakers have always garnered hype, the extreme measures customers are taking to get the shoes are a relatively recent development, and may be thanks to the ubiquity of sites like eBay that allow shoe flippers to sell the sneakers at a profit, according to Niyah Kerr, a manager at the Manhattan shoe store Kith.

“The sneaker game has definitely changed into a new breed,” said Kerr, who has collected sneakers for about five years. “Before it was a small culture, now people resell the shoes and don't even wear them.

Mike Watson, the owner of Got Sole?, a shoe store in Indianapolis, echoed Kerr’s sentiments, noting, “That’s the hype.”

Instead of true sneaker connoisseurs trying to get the shoe for themselves you get this whole mass of population that could care less about the shoe trying to make a quick buck on the resell,” he said.

Watson said he got an email from Nike about the new release rules in March of this year. The Orlando sneaker riots took place at the end of February. (SOURCE)

New Article: Charles Barkley Joins The Dream Team In NBA 2K13

Wednesday, August 15, 2012

Though many sports games successfully capture the spirit and culture of contemporary sports, few tap the rich vein of sports history. For years Madden featured legendary teams, but stopped short of including the official player names and likenesses. The NHL series celebrated the Montreal Canadiens’ 100-year anniversary with a team of all-time greats like Maurice “Rocket” Richard, but they had no historical rivals to compete with. With Electronic Arts owning the NFL license, 2K Sports mashed up an impressive roster of Hall of Famers in All-Pro Football 2K8, but without the official team licenses this brilliant concept didn’t resonate like it should have.

Visual Concepts finally struck gold with NBA 2K11’s Jordan Challenge, which allowed users to step into the shoes of His Airness in several painstakingly recreated historical matchups that featured authentic rosters, jerseys, and even television broadcast presentation. Both longtime fans and younger hoopsters who never watched Jordan play in his prime celebrated the mode. For NBA 2K12, the development team took it a step further in creating 15 of the most memorably teams in hoops history with the NBA’s Greatest mode. Though most of the most memorable players from the past 60 years of made appearances, including Magic Johnson, Larry Bird, Michael Jordan, and Wilt Chamberlain, one man was noticeably absent from the festivities: Sir Charles Barkley.

The former Philadelphia 76ers and Phoenix Suns hall of fame power forward is no stranger to video games. During the peak of his career he graced the cover of his own game, Barkley Shut Up and Jam!, and appeared in countless other games like Tecmo Super NBA Basketball and NBA Jam. After he traded throwing elbows on the hardcourt for throwing barbs as a basketball analyst for TNT, however, he refused to have anything to do with video games. Though 2K approached him about appearing in its NBA’s Greatest mode last year, they were unable to reach an agreement.

With Team USA announcing its roster for the Olympics earlier this year, barbershops around the nation buzzed with the discussion of whether or not the new team could hold a torch to the original 1992 Dream Team. NBA 2K13 executive producer Jay-Z thought it would be a great idea to let these two juggernauts square off on the virtual court.

"He asked, ‘Did you get the original Dream Team?’ We were like, ‘We have most of the players, but not all of them,’” recalls senior producer Rob Jones. Most of the players were available for the right price, but Barkley was still playing hard to get. Jay-Z wasn’t having it. "He said, ‘What do you mean not going to have the Dream Team?’ Jones remembers. “We said, ‘We don't feel that it would be useful if you don't have Barkley on it, and Barkley has notoriously not wanted to be in games since he retired.’ He said, ‘That's crap.’”

The rap mogul, Rocawear founder, partial owner of the Brooklyn Nets, and longtime basketball fan demanded Barkley’s phone number. In less than 24 hours, Barkley was on board.

He talked to our VP Jeff [Thomas], and Jeff comes in and goes to the meeting,” Jones says. “The next day he comes back and we're sitting in a meeting and the phone rings. He says it's Jay and he says, ‘Oh, by the way, Barkley said yes.’ We were like, 'Really? That's all it takes?’… We're stoked about [it].”

When you’re abusing the shaky (by comparison) frontcourt of Tyson Chandler, Anthony Davis, and Kevin Love with the undeniable forces of Patrick Ewing, David Robinson, Karl Malone, and Charles Barkley in NBA 2K13, remember to thank S. Carter.

Now he needs to get on the phone and throw his weight around with Scottie Pippen, the lone player missing from the Dream Team. Pippen is a mysterious exclusion considering he appeared in each of the past two editions of the game. So why is he not in NBA 2K13? 2K Sports is being vague.

"There's no doubt in our minds that Scottie Pippen was a key part of the gold-medal winning 1992 squad," says 2K Sports vice president of marketing Jason Argent. "We continue to have a very positive relationship with Scottie, but were unable to include him in-game this year for a variety of reasons, though we share everyone's hope that he may one day appear in our game.”

As one of the best defensive small forwards of all time, the Dream Team would certainly get him on the floor to man up against Kevin Durant. As for now, I guess an aged Larry Bird with a bad back and the undersized sharp shooter Chris Mullin will handle the daunting task. I'm sure that will end well...
